June 2023 Minutes

The regular monthly meeting of the Mayor and the Board of Commissioners was held on June 13, 2023 at the Stovall Town Hall at 6:00 pm

Mayor Williford called the meeting to order and began with the Pledge of Allegiance.


Invocation:

Commissioner Sneed spoke an opening prayer.


Swearing in of Town Clerk:

Mayor Williford swore in Ummala Rowley to serve as Town Clerk for Stovall.


Public Hearing '23-24 Budget:

Mayor Williford presented the following budget for ‘23-24. A motion was made by Commissioner Lunsford and seconded by Commissioner Stovall that the public hearing for the ‘23-24 year be open for discussion. Motion carried unanimously. Mayor Williford ask for any comments concerning the budget. Mayor Williford recognized Allen Nelson. Mr. Nelson ask about the funds for the water grants. Mayor Williford explained that those budgets would be included at a later time. He explained that the grant budget would be included as the projects progressed. There being no further comments, a motion was made by Commissioner Sneed and seconded by Commissioner Lunsford that the public hearing be closed. Motion carried unanimously.


PUBLIC HEARING FOR ALLEY CLOSING OFF OF OXFORD STREET:

A motion was made by Commissioner Stovall and seconded by Commissioner Sneed that the public hearing for the alley closing off on Oxford Street be open for public comment. Motion carried unanimously. Attorney Currin stated that the county was asking for the closing off of the alley off of Oxford Street that is now owned by the county. Attorney Currin discussed the agreement and stated that one property owner, Brad Matthews has forfeited his right over to the county and it is to be included with in the revised agreement. There being no public comment, a motion was made by Commissioner Sneed and seconded by Commissioner Lunsford that the public hearing be closed. Motion carried unanimously.


Mayor’s Update:

Mayor Williford and Administrator Janet Parrott will be meeting with Jared Wright sometime this week. Town will be filing a letter to the Division of Water Infrastructure for extension. Construction comment on Phase II for asking extension 03-01-2024 to 09-02-2024 expected to be built by 2025.


Police Report:

Chief Williams gave an activity report for the Police Department for the month.

Activity was as follows:


· 395 miles of patrol

· 4 reports

· 9 citation

· 0 arrest


Water Report:

Commissioner Doug Lunsford gave the water report and stated that Oxford billed town for 647,000 gallons and Stovall billed the customers for 688,490 gallons of water. There was a small water break on Saturday, June 10, 2023 at Railroad Street and fixed on Sunday, June 11, 2023. Commissioner Lunsford mentioned the sewer plant has an air leak and needed to be repaired.


Approval of Minutes:

A motion was made by Commissioner Lunsford and seconded by Commissioner Sneed to approve the June 2023 minutes. Motion carried unanimously.


Old Business


Recreation Funds Granville County:

Mayor Williford stated that the town has been awarded the recreation funds for picnic tables, benches and trash receptacles. Mayor stated several other grant applications for different parks were denied.


New Business


Engineering Contact (Water and Sewer):

A motion was made by Commissioner Stovall and seconded by Commissioner Lunsford that the town approve the basic Engineering Contract for the four grants and that each grant will have a Task Order Number with Project Description and Scope of Services. A motion was made by Commissioner Stovall and seconded by Commissioner Lunsford that the Town of Stovall approve the Master Services Agreement. Motion carried unanimously.


'23-24 Budget Ordinance:

The 23-24 Budget Ordinance was approved by Commissioner Doug Lunsford and seconded by Commissioner Ricky Sneed. Motion carried unanimously.

YEAR JULY 1, 2023 TO JUNE 30, 2024.


BE IT ORDAINED by the Mayor and Board of Commissioners of the Town of Stovall, North Carolina in regular session assembled June 13, 2023

Section I. That the following amounts are appropriated for the operation of Stovall government and its activities for the fiscal year beginning July 01, 2023 and ending June 30, 2024 according to the following summary:

WATER FUND 288,050.00


TOTAL BUDGET $624,024.00

Section V. Tax Rate: There is hereby levied for the fiscal year ending June 30, 2023 the following rate of taxes on each $100 assessed valuation of taxable property listed as of January 01, 2023:


Tax Rate= $0.49 per 100 Dollars Value


The discount schedule for early payment of taxes is the same as Granville County’s Schedule.

The tax rate of $0.49 per 100 Dollars Value and this budget for General Fund and Water/Wastewater Budget Ordinance adopted this 13th day of June, 2023 on a motion made by Commissioner Doug Lunsford and seconded by Commissioner Ricky Sneed. Motion carried unanimously.

W. L. Stark and Company ('23-24):

A motion was made by Commissioner Lunsford and seconded by Commissioner Sneed that the Town of

Stovall approve the ‘23-24 contract agreement with W.L. Stark and Company. Motion carried unanimously.

Alley Way off of Oxford Street:

A motion was made by commissioner Stovall and seconded by commissioner Sneed that following closing unnamed street or alley be approved as follows. Motion carried unanimously.


STATE OF NORTH CAROLINA

TOWN OF STOVALL

ORDER CLOSING UNNAMED STREET OR ALLEY

G.S. 160A-299

WHEREAS, the Town of Stovall has the authority pursuant to N.C. Gen. Stat. § 160A-299

to close any street or public alley within its corporate boundaries following published notice and

public hearing;

WHEREAS, on April 11, 2023, the Board of Commissioners of the Town of Stovall adopted

a Resolution of Intent to Close an Unnamed Street or Alley pursuant to N.C. Gen. Stat. § 160A-299;


WHEREAS, in 1973 the Estate of Laura Anne Taylor subdivided property pursuant to

survey by Harold B. Mullen, RLS dated November 8, 1973, and such plat designated a 25-foot street

or alley thereon which area has never been developed into a road;


WHEREAS, the properties which appear upon said plat and which abut said 25-foot street or

alley and need said road for access are now owned entirely by Granville County;


WHEREAS, other than Granville County, James Bradley Matthews (“Matthews”) is the

only record owner of property adjoining said alleyway, but his property is accessed via Main St. and

does not rely on said alleyway for access and Matthews, as evidenced by his signature on the County

Recombination Plat (as defined below) and pursuant to G.S. 160A-299(c), has consented to that

portion of closed alley that would have otherwise vested in him instead for said ownership vest solely

in Granville County;


WHEREAS, the County intends to develop the entire property as one piece and does not

need the 25-foot street or alley for access to any of the parcels, and there is no existing public use of

the road;


WHEREAS, said street or alley appears to have been offered as a public right of way but

was never accepted or maintained by the Town of Stovall as a public road and it appears to the Board

that closing said road would not affect the access to any property and that it should be permanently

closed;


WHEREAS, no individual owning property in the vicinity of the street or alley or in the

subdivision in which it is located would thereby be deprived of reasonable means of ingress and

egress to his or her property;


WHEREAS, permanently closing said street or alley is not contrary to the public interest;

and,


WHEREAS, the Town of Stovall advertised by public notice a public hearing pursuant to

N.C. Gen. Stat. § 160A-299 on June 13, 2023 to hear all public comment on the question of closing

the alley, and such public hearing was held on June 13, 2023.


NOW THEREFORE, BE IT ORDERED AND RESOLVED:

1. That the Town of Stovall does hereby close the 25-foot unnamed street or alley shown as Lot

“C” on the attached plat entitled “Recombination Survey and Property of Granville County”

prepared by Barry H. Oakes Surveying, P.A., dated April 24, 2023 of record in Plat Book

_______, Page ______, Granville County Registry (the “County Recombination Plat”), to



which reference is made for a more particular description thereof, and a copy of which is

attached hereto and incorporated by reference herein as Exhibit A.


2. That G.S. 160A-299(c) provides in pertinent part as follows: “[u]pon the closing of a street

or alley in accordance with this section . . . all right, title, and interest in the right-of-way

shall be conclusively presumed to be vested in those persons owning lots or parcels of land

adjacent to the street or alley, and the title of such adjoining landowners, for the width of the

abutting land owned by them, shall extend to the centerline of the street or alley.” G.S. 160A299(c) further provides that “[t]he provisions of this subsection regarding division of right of-way in street or alley closings may be altered as to a particular street or alley closing by

the assent of all property owners taking title to a closed street or alley by the filing of a plat

which shows the street or alley closing and the portion of the closed street or alley to be taken

by each such owner. The plat shall be signed by each property owner who, under this section,

has an ownership right in the closed street or alley.”


3. That pursuant to G.S. 160A-299(c), all the property owners adjoining the street or alley being

closed under the terms hereof and who would be taking title to the closed street or alley, have

agreed and consented that all right, title, and ownership in and to the closed alleyway shown

on as “Lot C” on the County Recombination Plat shall vest solely in Granville County.


4. That a copy of this Order shall be recorded in the Registry of Granville County.


Duly adopted by the Town of Stovall Board of Commissioners at regular meeting, this the

day of June, 2023.

Continuation Meeting:


Mayor Williford stated the meeting will be continued until June 28, 2023 at 6:00, a motion made by Commissioner Jeff Stovall and seconded by Commissioner Doug Lunsford. Motion carried unanimously,

Contract with W.L. Stark, CPA

A motion was made by Commissioner Stovall and seconded by Commissioner Lunsford that the contract for W.L. Stark and Company be approved as submitted in the amount of $12,900. Motion carried unanimously.


2022-2023 Budget General Fund and Water

Administrator Parrott reviewed the amended Water Fund Budget 2022-2023 and the amended

General Fund budget.

A motion was made by Commissioner Doug Lunsford and seconded by Commissioner Carl Roberts that the 2022-2023 General Fund budget be approved as submitted totaling $369,358.00. Motion carried unanimously.

A motion was by Commissioner Stovall and seconded by Commissioner Doug Lunsford that the amended Water Fund budget totaling $304,539.00 be approved as submitted. Motion carried unanimously.

There being no further business, meeting was adjourned on a motion by Commissioner Stovall and seconded by Commissioner Lunsford. Motion carried unanimously.
